Este estudio tiene como propósito explicar la relatividad del secreto médico y la actuación del médico perito. El secreto profesional médico es un derecho a la intimidad y constituye obligación ineludible para el personal de la salud, los pacientes y peritados, de ahí que todo lo que revelen deba ser guardado para evitar daños a la vida privada de los individuos. Desde el punto de vista ético el secreto médico profesional obliga al perito a no revelar más de lo necesario (...) para el peritaje, así como a no divulgar dicho informe, limitándose a entregarlo solamente a quienes tuvieran derecho a él. This study aims at explaining the relativity of medical secrecy and the performance of the medical expert. The medical professional secrecy is a right to privacy and it is an unavoidable obligation for the health staff, and assessed patients, hence everything they reveal must be stored to prevent damage to the private life of individuals. From the ethical point of view medical confidentiality forces the expert not to disclose more than necessary for the expertise, as well as not to disclose such report, just limited to be delivered to those who had right to it. En la educación médica cubana se ha diseñado un currículo para el cumplimiento de su encargo social donde se inserta la enseñanza del inglés. Actualmente constituye una prioridad trabajar en la búsqueda de estrategias que favorezcan el perfeccionamiento idiomático de los egresados, en este sentido se desarrolló una investigación en la Filial de Ciencias Médicas de Colón con el objetivo de desarrollar la expresión oral en el inglés con fines específicos en el tercer año de la carrera de Medicina. Se (...) emplearon métodos como el análisis de documentos, la observación participante, y los registros anecdóticos. El sistema de actividades aplicado favorece la negociación de significados, toma de riesgos, mayor precisión al expresar ideas, así como el acercamiento del uso del idioma en situaciones reales con lo cual se logra mayor motivación, objetividad del aprendizaje e independencia, al emplear las habilidades lingüísticas para su desempeño profesional. In Cuban medical education, a curriculum in which English is integrated, is designed to fulfill a social mission. Presently, it is a priority to identify strategies that support the idiomatic improvement of graduates. To this end, an investigation was developed in the University of Medical Sciences of Matanzas at Colon Campus with the objective of developing speaking in English for Specific Purposes in the third-year of the medical program of study. Methods such as document analysis, participant observation, and review of anecdotal records were used. The resulting system of activities favors the negotiation of meaning, risk-taking, improved precision to express ideas and the expanded use of English language in real situations. This results in greater motivation, learning objectivity and independence to use language skills for their professional performance. (shrink)

What is the relationship between impunity and economic and social rights? A substantiated expectation of impunity encourages the commission of acts that violate human rights. Using a logistic-multinomial regression model, we find that impunity affects per capita GDP, years of schooling, and life expectancy. An unexpected finding was that different civil and political rights systems, as diverse as those of Norway and Singapore, have similar impacts on both impunity and economic and social rights. COVID-19 is an acute respiratory illness with higher mortality in older adults. This condition is spread person-to-person through close contact, and among policies employed to decrease transmission are the improvement of hygiene habits and physical distancing. Although social distancing has been recognized as the best way to prevent the transmission, there are concerns that it may promote increased depression symptoms risk and anxiety, mainly in older adults. This cross-sectional study aimed to verify self-concept of social distancing in adults compared to (...) older adults. All participants, over 18 years and residents of São Paulo state, were invited to join this research study by a message application and answered an interdisciplinary questionnaire during the period from May 23 to June 23, 2020. The questions were divided into the following aspects: sociodemographic data, financial conditions, routine-related perception, perception of health, physical and emotional state, and eating habits. The younger adult group was composed of 139 participants, with a mean age of 43.15 years, and the older adult group was composed of 437 participants with a mean age of 67.59 years of both sex. Changes in routine during the period of social distance were reported by 95% of adults and 96.8% of older adults, but adults indicated more significant alterations in routine. Although there was no difference between groups for several aspects, adults revealed greater alterations in sleep quality, evacuation frequency, and more difficulty to perform daily activities at home. Further studies are necessary to follow up the impacts of social distancing among adults and older adults in different socioeconomic contexts to better understand the long-term alterations and the necessity of interventions. Feminist anthropologists have evidenced the social and cultural aspects of motherhood and have challenged the universality of the nuclear family as the basis for residential and child-rearing practices. From a feminist anthropological perspective, the concept of the household has thus been redefined to capture the ways in which different principles of household recruitment and residence shape the activities and access to resources of women and men of different ages and status. This paper examines the relationship between household composition and coffee (...) production in Ocotal Grande, a Popoluca community in the Sierra de Santa Marta in Southern Veracruz, Mexico. It shows that polygamous households are larger and have higher yields of coffee than other types of households. However, this does not mean that all members of the household profit equally from their contribution to coffee production. While some relationship exists between labor input and returns, the distribution of benefits is based on gender and age hierarchies and is open to conflict and dispute. (shrink)

The Fairness, Accountability, and Transparency (FAccT) literature tends to focus on bias as a problem that requires ex post solutions (e.g. fairness metrics), rather than addressing the underlying social and technical conditions that (re)produce it. In this article, we propose a complementary strategy that uses genealogy as a constructive, epistemic critique to explain algorithmic bias in terms of the conditions that enable it. We focus on XAI feature attributions (Shapley values) and counterfactual approaches as potential tools to gauge these conditions (...) and offer two main contributions. One is constructive: we develop a theoretical framework to classify these approaches according to their relevance for bias as evidence of social disparities. We draw on Pearl’s ladder of causation (Causality: models, reasoning, and inference. Cambridge University Press, Cambridge, 2000, Causality, 2nd edn. Cambridge University Press, Cambridge, 2009. doi:10.1017/CBO9780511803161) to order these XAI approaches concerning their ability to answer fairness-relevant questions and identify fairness-relevant solutions. The other contribution is critical: we evaluate these approaches in terms of their assumptions about the role of protected characteristics in discriminatory outcomes. We achieve this by building on Kohler-Hausmann’s (Northwest Univ Law Rev 113(5):1163–1227, 2019) constructivist theory of discrimination. We derive three recommendations for XAI practitioners to develop and AI policymakers to regulate tools that address algorithmic bias in its conditions and hence mitigate its future occurrence. Experiential imagination consists in an imaginative projection that aims at simulating the experiences one would undergo in different circumstances. It has been traditionally thought to play a role in how we build our lives, engage with other agents, and appreciate art. Although some philosophers have recently expressed doubts over the capacity of experiential imagination to offer insight into the perspective of someone other than our present-selves, experiential imagination remains a much sought-after tool. This paper substantiates pessimism about the epistemological value (...) of these uses of experiential imagination by developing an embodied approach. Our thesis is that experiential imagination is _robustly embodied_ because the _sociohistorically situated_ body makes an irreducible contribution to the imaginative project, and that, as such, it is constrained by who we are as _concrete_ agents. We argue that experiential imagination is an embodied, virtual exploration of imagined scenarios that depends on our situated history of sensorimotor and affective interactions. We conclude that experiential imagination is much more limited than commonly acknowledged, as it can hardly be divorced from who we are and where we have been. (shrink)

Advocates of interactionism in the ethical criticism of art argue that ethical value impacts aesthetic value. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...) actual agents, fictional artworks only have extrinsic ethical value. I show that what is at stake for interactionism is whether ethical judgements concerning artists’ attitudes in a context, rather than manifested attitudes, are ever aesthetically relevant. I conclude that, without buying into extreme actual intentionalism, a still controversial theory of interpretation that ties artworks’ meaning to actual artists, interactionism fails to show that ethical flaws/merits are aesthetic flaws/merits. Advocates of the ethical criticism of art claim that works' ethical defects or merits have an impact on their aesthetic value. Against ethical critics, autonomists claim that moral criteria should not be part of the considerations when evaluating works of art as art. Autonomism refers to the view that an artwork's aesthetic value is independent from its ethical value. The purpose of this paper is to examine how autonomism has been defended in the contemporary discussion in analytic aesthetics. I present (...) three versions of autonomism: Richard Posner's radical autonomism, James C. Anderson and Jeffrey T. Dean, and James Harold's moderate autonomism, and Francisca Pérez Carreño's robust autonomism. I argue that robust autonomism offers a stronger argument against the ethical critic. However, I point to some difficulties for Pérez Carreño's account and conclude by suggesting how further work in autonomism might go around them. (shrink)

Recent attempts to undermine his argument rely either on the claim that diminishing certain capacities always harms an animal's welfare or on the claim that it always violates an animal's integrity. I argue that these fail. However, respect for animal dignity provides a defeasible reason not to engineer an animal in a way that inhibits the development of those (...) functions that a member of its species can normally perform, even if the modification would improve the animal's welfare. The central idea behind this paper is that presuppositions of soft triggers arise from the way our attention structures the informational content of a sentence. Some aspects of the information conveyed are such that we pay attention to them by default, even in the absence of contextual information. On the other hand, contextual cues or conversational goals can divert attention to types of information that we would not pay attention to by default. Either way, whatever we do not pay attention (...) to, be it by default, or in context, is what ends up presupposed by soft triggers. This paper attempts to predict what information in the sentence is likely to end up being the main point (i.e. what we pay attention to) and what information is independent from this, and therefore likely presupposed. It is proposed that this can be calculated by making reference to event times. The notion of aboutness used to calculate independence is based on that of Demolombe and Fariñas del Cerro (In: Holdobler S (ed) Intellectics and computational logic: papers in honor of Wolfgang Bibel, 2000). Some presuppositions are easier to cancel than others in embedded contexts. This contrast has been used as evidence for distinguishing two fundamentally different kinds of presuppositions, ‘soft’ and ‘hard’. ‘Soft’ presuppositions are usually assumed to arise in a pragmatic way, while ‘hard’ presuppositions are thought to be genuine semantic presuppositions. This paper argues against such a distinction and proposes to derive the difference in cancellation from inherent differences in how presupposition triggers interact with the context: their focus sensitivity, anaphoricity, and (...) question–answer congruence properties. This paper examines a little studied type of perspective shift that I call protagonist projection, following Holton :625–628, 1997). PP is a way of describing the mental state of a protagonist that conveys, to some extent, her perspective. Similarly to its better known cousin free indirect discourse, the shift in perspective is achieved without an overt operator. Unlike FID, PP is not based on a presumed speech-act of a protagonist. Rather, it gives a linguistic form to pre-verbal perceptual content, sensations, (...) feelings or implicit beliefs. I propose to analyse PP in a bi-contextual framework, extending Eckardt’s approach to FID. Under the resulting analysis, FID and PP are two instances of a more general category of perspective shift. En este trabajo realizamos una revisión historiográfica sobre la fabricación de anatomías artificiales que fueron ampliamente demandadas como herramientas didácticas en la enseñanza de la naturaleza, entre finales del siglo XVIII y principios del XX. Se analizan los contextos educativos y sociales que favorecieron la amplia difusión de este tipo de artefactos en el comercio de la cultura científica, y se describen las técnicas de manufactura. Se concluye que estos artefactos, fruto del ingenio humano, son fuentes materiales de extraordinario valor (...) para comprender la construcción y evolución de la ciencia, los avances en los recursos pedagógicos y las innovaciones tecnológicas. For different reasons, Husserl's original, thought-provoking ideas on the philosophy of logic and mathematics have been ignored, misunderstood, even despised, by analytic philosophers and phenomenologists alike, who have been content to barricade themselves behind walls of ideological prejudices. Yet, for several decades, Husserl was almost continuously in close professional and personal contact with those who created, reshaped and revolutionized 20th century philosophy of mathematics, logic, science and language in both the analytic and phenomenological schools, people whom those other makers of (...) 20th century philosophy, Russell, Frege, Wittgenstein and their followers, rarely, if ever, met. Independently of them, Husserl offered alternatives to the well-trodden paths of logicism, nominalism, formalism and intuitionism. He presented a well-articulated, thoroughly argued case for logic as an objective science, but was not philosophically naive to the point of not seeing the role of subjectivity in shaping the sense of the reality facing objective science. Given the preeminent role that philosophy of logic and philosophy of mathematics have played in transforming the way philosophy has been done since Husserl's time, and given the depth of his insights and his obvious expertise in those fields, his ideas need to be integrated into present-day, mainstream philosophy. Here, philosopher Claire Ortiz Hill and mathematician-philosopher Jairo da Silva offer a wealth of interesting insights intended to subvert the many mistaken idees recues about the development of Husserl's thought and reestablish broken ties between it and philosophy now. Aesthetic evaluations of human bodies have important implications for moral recognition and for individuals’ access to social and material goods. Unfortunately, there is a widespread aesthetic disregard for non-white bodies. Aesthetic evaluations depend on the aesthetic properties we regard objects as having. And it is widely agreed that aesthetic properties are directly accessed in our experience of aesthetic objects. How, then, might we explain aesthetic evaluations that systematically favour features associated with white identity? Critical race philosophers, like Alia Al-Saji, Mariana (...) Ortega, Paul C. Taylor, and George Yancy, argue that this is because the perception of racialized bodies is affected by the social structures in which they are appreciated. The aim of this paper is to propose how social structures can affect aesthetic perception. I argue that mental imagery acquired through the interaction with aesthetic phenomena structures the perception of non-aesthetic properties of bodies, so that aesthetic properties consistent with racist stereotypes are attributed to individuals. El súbito consenso que se ha producido en nuestros días alrededor de la importancia de la noción democracia no se ha acompañado de una reflexión filosófica sobre su sentido moderno. La obra filosófica de Claude Lefort ha contribuido a llenar este vacío teórico. Para Lefort, el sentido de la democracia moderna no puede revelarse, como ha supuesto la ciencia política, a través de la descripción del funcionamiento de sus instituciones, sino puede estudiarse mediante la exploración de su dimensión simbólica. En (...) efecto, la fundación y el destino de la democracia son inseparables de la indeterminación de sus fundamentos y de la infigurabilidad del poder, de la ley y del saber. Origen y destino que bien pueden ser rastreados a la luz del contraste entre la sociedad democrática y la sociedad totalitaria. El presente ensayo se ocupa de contrastar la dimensión simbólica de ambas formas de sociedad. Rather, it may be studied by exploring its symbolic dimension. In fact, democracy’s origin and fate are inseparable from the indeterminacy of its foundation and the non-figurable nature of power, law and knowledge. Such an origin and fate may indeed be tracked in light of the contrast between the democratic society and the totalitarian one. This article examines the role of the Spanish Atomic Forum as the representative of the nuclear sector in the public arena during the golden years of the nuclear power industry from the 1960s to 1970s. It focuses on the public image concerns of the Spanish nuclear lobby and the subsequent information campaigns launched during the late 1970s to counteract demonstrations by the growing and heterogeneous anti-nuclear movement. The role of advocacy of nuclear energy by the Atomic Forum was similar to (...) that in other countries, but the situation in Spain had some distinguishing features. Anti-nuclear protest in Spain peaked in 1978 paralleling the debates of a new National Energy Plan in Congress, whose first draft had envisaged a massive nuclearization of the country. We show how the approval of the Plan in July 1979, with a significant reduction in the nuclear energy component, was influenced by the anti-nuclear protest movements in Spain. Despite the efforts of the Spanish Atomic Forum to counter its message, the anti-nuclear movement was strengthened by reactions to the Three Mile Island accident in March 1979. (shrink)

This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present, and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. This article examines what constitutes an ethical flaw in artworks and asks which ethical flaws are relevant in determining works. ethical and aesthetic values. I argue that while most of the discussion has simply taken for granted that it is intrinsic ethical flaws that should be taken into account, there are further important differences in the type of intrinsic ethical flaws that artworks display. I identify two different types of ethical defects in artworks, fictional and actual, and argue that this (...) distinction has important consequences for debates surrounding the ethical value of works of fiction. It has been pointed out that Sensorimotor Enactivism, a theory that claims that perception is enacted and brought about by movement, says very little about the neural mechanisms that enable perception. For the proponents of the predictive approach to Sensorimotor Enactivism, this is a challenge that can be met by introducing predictive processing into the picture. However, the compatibility between these theories is not straightforward. Firstly, because they seem to differ in their stand towards representations: while Sensorimotor Enactivism is said (...) to belong to the non-representational wing of cognitive science, predictive processing has a representational profile. And secondly, because they exhibit different explanatory strategies: while Sensorimotor Enactivism prioritizes the interactions of the embodied agent, predictive processing has internalist commitments. The aim of this paper is to address these concerns and show that a predictive approach to Sensorimotor Enactivism is viable. More specifically, I focus on the Free-Energy approach, a theory that falls within the ballpark of predictive processing. In this paper I argue for the following claims. I argue that both Sensorimotor Enactivism and the Free-Energy approach may be understood for some systems in representational terms. The non-representational reading of Sensorimotor Enactivism is not mandatory and neither is the representational reading of the Free-Energy approach. Sensorimotor Enactivism is, in this respect, compatible with both representational and non-representational interpretations of the FEA. So, the position towards representations of these frameworks should not stand in the way of a predictive approach to Sensorimotor Enactivism. I also show that the Free-Energy approach allows for an account that prioritizes the interaction of the embodied agent with the environment. This is the explanatory strategy followed by Sensorimotor Enactivism. To justify this strategy and following other proponents of Sensorimotor Enactivism, I argue that by referring to the interactions of the embodied agent a better account of the phenomena in question is provided. On this basis, I claim that Sensorimotor Enactivism and the Free-Energy approach are compatible in what concerns their explanatory strategy as well. Thus, making the case for the viability of the predictive approach to Sensorimotor Enactivism. (shrink)

Sometimes subjects have sufficient internal and external resources to retrieve information stored in memory, in particular information that carries socially charged content. Yet, they fail to do so: they forget it. These cases pose an explanatory challenge to common explanations of forgetting in cognitive science. In this paper, I take this challenge and develop a new explanation of these cases. According to this explanation, these cases are best explained as cases of norm-induced forgetting: cases in which forgetting is caused by (...) social norms in a relevant sense. These cases draw attention to the normative aspects of the mechanisms of forgetting. This is an important but neglected aspect of cases of everyday forgetting, in particular of those characterized by a social dimension. By investigating some ways in which the psychology of social norms is causally relevant in the mechanisms of retrieval failure, I begin to fill this gap. (shrink)
